You're out of pocket because YOU choose to be out of pocket.

NO ONE is forcing you to pay the higher prices, this is YOUR decision. BBTS is NOT responsible for any decision YOU make.

I get that you want them for your kids, but at the same time, if you can't get them at a reasonable price, YOU GET SOMETHING ELSE. IT'S THAT SIMPLE.

Did BBTS screw up? Yeah, but they've done plenty to make up for their screw up. That $15 they credited you? That's 7.5% interest, you and I both know you wouldn't have gotten that from the bank.

You made your issue clear, what's happened has happened, continuing to run down BBTS is not going to achieve anything.

BBTS paid what they owed (and more). They gave you back every penny you gave to them. It sucks, but there really is nothing more legally that they owe you because believe it or not, it is not the retailer's responsibility to make sure that you get the products you want. It is only to provide you with the products they stock that you pay for, and short of that, to return any money you've given to them if they cannot fill the order.

You speak as though you absolutely must have those Rescue Bots, but that's not what BBTS (nor any other business, nor any court of law) sees at all. They see that you gave money for a product, the product was not instock, and the money you gave them was returned. When that actually happened is only relevant because they found the product to be unavailable when you actually went to ship the item. If you take the delay and POL out of the issue it becomes very clear. You would have ordered something on a day it was instock and available, they would have processed the order and found that they had none instock and they would have refunded your money and legally there's nothing more they'd need to do. Delaying the completion of that process through the use of POL (whose ship date YOU control by the way, not them) changes nothing.

Legally they have done everything required of them and more.

Yes, it sucks that it happened and sucks even more that you can't get your Rescue Bots for a reasonable price. I know I'd be pissed if I ordered say a new MP on preorder and I got screwed like this and had to pay the inflated ebay prices to get one, but that's life and I wouldn't expect BBTS to pay for me to afford the ebay prices to make it right. I'd only expect a refund of my money, which they would certainly give (since legally they would have to).

Why are you filing a complaint with the BBB if they committed a criminal offense against you? The BBB handles consumer complaints, not large-scale corporate crime.

Preface - this will be my absolute last post in this particular thread, it's a train wreck.

You cannot compare: Service (repair) vs. Commodity (Transformer Toy) in a "legal" ( :lol: ) "argument" such as this.

Also, they have not caused you economic loss. They caused you to not own a toy. They refunded you the money you gave them to provide that object, then they gave you more because they messed up.

While it is unfortunate that you do not have the toy you paid for, at least you are not actually out any money.

If you choose to go pay for the same toy elsewhere, that is your choice, and it is beyond anyone's responsibility to reimburse you for that choice.

Anyway, I hope you can step back, take a deep breath, and think more clearly about this tomorrow. Besides, we're talking about Hoist and Medix, and they're pretty terrible. :)

I can not imagine how you're going to deal with the pressures of raising a family if you react like this to such a minor thing. Some things just aren't worth wasting your energy on. Let it go.

On the contrary, I wouldn't have had an issue if BBTS had've done their job properly to begin with. If there was a shortfall when their preorders came in and they'd told me about it then and there, then the problem wouldn't have been anywhere near this bad. Tbh, as this is my first shipped out order from BBTS and it's been this much of a train wreck, I wont be using them again and I'll be encouraging everyone I know to do the same.

Never mind the fact that I wouldn't even been in this position to begin with if it weren't for not only BBTS' initial screwup, but the second screwup of not telling me for over a year which only compounded the problem, right? As for the "plenty" you refer to, it doesn't even begin to make a dent in fixing the problem they caused.

By the way, it looks like HasbroToyShop.com still has some Rescue Bots instock. I'm not certain if any are the ones you were looking for, but the prices are $12.99 which, even with HTS' shipping fees, is probably way less than eBay's prices.

I do agree with you there. I don't agree that BBTS should be compensating you for it, but I DO agree that it sucks that they fill their orders this way. They need to check stock once it comes in and actually tag them in their system as being held in a POL that way they know that A: they actually have the item instock and set aside for the customer and B: can immediately inform a customer when something like this occurs and possibly look into quickly getting more stock before a product is completely discontinued (BBTS does sometimes use buyers, especially over in Japan, to get extra stock of popular items that can't be obtained through their normal wholesale channels).

Hence the reason why I referred to it as negligent embezzlement. The problem for me is that there is clearly an awareness on their part that they're dishonestly guaranteeing that if you've paid for something and have it in your pile of loot, that you will get it when you ship it out. Yet there is absolutely nothing in place (even in the measures they claim to be implementing) to ensure that is the case. The fact that they know that people are getting stung 6 and even 12 months down the track and are doing nothing to fix the problem - combined with an attitude of "it's rare, so who cares".

That goes beyond "hey we tried but sadly mistakes happen" to outright willful negligence as they are clearly aware that the current system effectively makes the POL one giant case of misleading advertising (clearly orders need to be physically allocated and isolated from unsold stock in their own warehouse) but apparently couldn't care less about fixing it.


The area of tort law known as negligence
involves harm caused by carelessness, not
intentional harm.

I get the negligence part, just not the embezzlement part. Embezzlement(a type of fraud) requires intent, and there is no such thing as unintentional fraud. So I don't get it.

sounds like a bad experience, but on the plus side, Hasbro will likely put out another sub-par line of toys aimed specifically at young children at some point in the near future that you could get and store away for theoretical children.

Bowspearer are you Bi-Polar? because i am and you sound exactly like the angry 8 yr old you become when your manic or having an episode. now i own a computer wholesale company, ive ran it for 20 yrs and I KNOW BUSINESS LAW.... your rant is without merit, and restitution is not due to you in any way at all, then didn't even need to do the $15. this happens all the time in any retail business. so stop your whining and dont use pol anymore, you pay a bit more in shipping costs, but you get your product.

if everyone filed a lawsuit on things not being available during the holidays, we would implode.

On topic, I don't understand why someone would even use Pile of Loot for a toy(s) they're going to just store away at home anyway. BBTS offers a "Pile of Loot" service, not a personal storage unit. >:oP

Plus, nothing beats having my instant gratification delivered to my door ASAP then having to wait for my "loot" to pile up. (way too tedious, sorry BBTS)

Bowspear, like myself, lives in the wonderful world of OZ :P PoL is kinda required so we don't pay through the nose on shipping. That said, I've never left any loot sitting for longer than four months because of the increased chance of stock issues (they are only human and sometimes damaged stock will slip through when shelf stacking).

You have every right to be annoyed by the situation, but that's about it. They refunded your money and spotted you $15.00, which is more than most would do. As many have pointed out in a multitude of ways you have no valid argument to go after them legally or file a complaint against them. That has nothing to do them being a site sponsor, and everything to do with reality. Don't think so? Go talk to attorney about the merits of your case.

Oh, and if you want to leave our community that's your decision, but if you can't take the heat on this forum I shudder to think how you'll fare elsewhere.

Rescue Bots toys are still being sold at stores. Your future unborn child most likely won't care if they're the later redecos that are currently available at retail which are considerably less expensive or if they're the in-demand-by-collectors expensive versions that originally came out a couple of years ago.

My daughter and her 4 year old friend next door both have a complete set of the originals. They'd both be happy with the new versions too ... but they've got the originals that were available for the first year and a half of this line. They love these things and boy have they beat the hell out of them like any 3 or 4 year old should.

It cracks me up that they're worth so much but makes me happy that they've gotten so much enjoyment. I'm glad I didn't know they'd be this valuable so that I could just enjoy seeing them play with them as extensively as they have over the past couple of years.

It's funny too because last year for Black Friday Target got in the last shipments in mass quantities that would become the super valuable versions just months later. They blew them out at $7 a pop.

The originals should be long gone. The new "Energize" versions with the blue translucent parts are what is currently available in stores.

They're valuable because supply and demand dictates price. Chase, Boulder and Blades were extremely hit or miss during the first year and a half. They'd show up, be gone, and then not show up in stores again for 6 to 12 months. Meanwhile, Bumblebee, Prime and Heatwave seemed to be in readily available supply. All of the product just kept selling out. I thought for sure when Target was flooded with Rescue Bots last Thanksgiving that the prices on them would finally retain a normal retail value, but that was it for supply. None of the other chains got them in stock and Target quickly sold out because of the cheap $7 price (almost half off). And if you haven't watched Rescue Bots, you really ought to turn it on your TV/DVR to have on while you're surfing the Internet or something. It's a decent show. Voice acting is really good. The show isn't dumbed down really. It even dealt with time travel even in last year's season finale ... not your typical stuff for a cartoon that should be aimed at preschool kids.

The originals should be long gone. The new "Energize" versions with the blue translucent parts are what is currently available in stores.

They're valuable because supply and demand dictates price. Chase, Boulder and Blades were extremely hit or miss during the first year and a half. They'd show up, be gone, and then not show up in stores again for 6 to 12 months. Meanwhile, Bumblebee, Prime and Heatwave seemed to be in readily available supply. All of the product just kept selling out. I thought for sure when Target was flooded with Rescue Bots last Thanksgiving that the prices on them would finally retain a normal retail value, but that was it for supply. None of the other chains got them in stock and Target quickly sold out because of the cheap $7 price (almost half off). You forget where I live, I can still find the odd ROFT toy, heck this one store had 6 RID Optimus Primes until ROTF hit. I'm going to take my chances, since the last time I checked I did see Rescue Robots, but they weren't the Energize versions with clear plastic.
I'll take a look, and should I find any and they're not priced in a way that it would be pointless to get them, I'll pic a few up and put them on ebay.
