In G1, the Predacons are just a subfaction of the Decepticons and are just one of many combiners. So in G1, they are "criminals", whereas in BW, not all of them are "criminals"- Dinobot and Blackarachnia even switched sides.
Technically when Dinobot switched sides he became a Maximal and Blackaracnia technically was a Maximal to begine with sence her Protoform was Maximal.
Anyway Predacons in Beast Wars aren't really "considered" criminals, they "are" criminals. Then again it allso depends on what you consider "criminal" to be.
Maximals are the decendants of Autobots. They belive in freedom for all sentient beings.
Predacons are the decendants of Decepticons. However the war between Autobots and Decepticons has long sence been over and the Autobots won. Maximals and Predacons are at a time of "peace" as far as the Maximals know.
Only small groups of Predacons are known criminals. These groups are Megatron's band of Predacon rebels who are considered criminals by Maximals and Predacons alike. Then there's Galvatron's band of Predacons who I guess work under the Tripdicus Council secretly and finally there's Magmatron who was chosen to replace Galvatron after he was defeated.
Megatron's group on Earth are the only rebal Predacons I'm aware of. They're rebals because they don't follow the laws of the Tripdicus Council (except for maybe Tarantulas who may have joined Megatron as a spy for the Tripdicus.)
