Could you ever see there 2 putting their differences to one side and creating potentially the greatest beat em up in history??. Has it ever been discussed between the 2? Maybe during the Amalgam days....

It will probably never happen due to legality and all that, but SNK and Capcom fought it out, as did Mortal Kombat and DC, so one never knows.
If it did ever happen they would need to find an awsome developer, and maybe even create a new fighting game engine. It would HAVE to be a good game. If it bombed, well, it would probably just be bad.
Also, if it did happen I gotta admit the first game would be kinda boring. The rosters wouldn't be huge, probably the 10 major characters from each company or something.

What differences? As far as I know, they seem pretty amicable for competitors. They did Marvel vs. DC a couple of times, and unless something changes, they're both co-owners of the term "super hero."

Not necessarily. There would be legal issues if, say, Spider-Man was included without Marvel's consent. As long as both Marvel and DC agree to do it, there's no legal issues, at least not with the characters.

I'd like to see a capcom vs DC first. If that happened, then yeah, you might see a marvel vs dc made by capcom.

Well Capcom vs Marvel worked as the basic characters used to represent Marvel worked within the confines of a fighter. DC vs MK however didn't. The under/overpowering of certain characters in order to fit the confines of the game. There in which defines the main issue with making a crossover game a fighter.
However if you made a crossover game into a strategy based game following SuperRobotWars or a video-game version of hero-cliqs, where the power difference could be offset depending on mission peramiters, then a game could be worked on that would fit all the characters, but would be of enough interest to get the sales?

Actually one of my main problems with Marvel vs. Capcom basically boils down to "Ryu should not be able to beat the Hulk in a fist-fight." Not to say DCvsMK didn't have it's fair share of nerfing for DC characters, but MvC isn't much better.
