That's not gonna happen either, for a couple of reasons:
1) Hasbro may look the other way for most third-party products, but if a third-party tried to make a Megatron based on the design from Universal's movie, that company would most certainly be slapped with a cease-and-desist order for copying Universal's IP.
2) Third party companies have better things to do with their resources. I think they'd rather do something that allows them to be creative and make something unique, not just a bigger version of an existing Hasbro product.

Yes, a Leader-class DOTM Megatron would have been sweet, but it's not happening.
Well.....While I seriously agree with you about it's not gonna happen some of this is ahhh......
1) While Hasbro had leased agreements with chevy and some of the military designs, Megatron was just an old truck design. 3rd party groups have used many similar designs to other forms used by Hasbro and what not. Perhaps it's easier to get away with due to the fact that there G-1 era they are copying currently, like Devy but..... using an old truck design into a robot would be hard to stop. And Hasbro wouldn't cry too much because there wouldn't be thousands released. 3rd party groups know there really selling to collectors. For every 10 collectors that honestly say...that would be awesome to own, only 2-3 are seriously going to either buy, or be able to afford it. Being only one character vs the 6 that make up Hercules it will probably make bigger numbers then the "6 constructicons" but not in a big enough way to make Hasbro cry foul. It's not illegal to offer an alternative. As long as it doesn't hold the Megatron name, Or Transformers logo, it would probably clear.
2) creating something unique.....hmmm....like the two 3rd party devys? That's not unique by any means recreating the most common combiner used. Very cool and far better then anything Hasblow will every come up with, but not unique. They probably follow the same performance system model that most use when creating. Paper to test model, realisticness and availability compared to cost effective to supply and demand.
But I believe your absolutely right..... Megatron will probably not see a 3rd party nod.
