never received my ebay item
guys i need some advice. a couple weeks ago i won a rm-12 starscream misb. i payed with paypal and the seller shipped it out on 10-18 using usps. he gave me the tracking number and the delivery was confirmed on 10-20. the problem is i never got the damn package. has this ever happened to any of you? in my entire life i've gotten dozens and dozens of packages and have never once had a problem. NOT ONCE. i tried calling usps several times and they really haven't done anything to help me out. they did say they asked my carrier but he wasn't much help obviously. a package just doesn't disappear. the seller and i have also exchanged numerous e-mails but he is no help either and he refuses to refund me. a claim was filed with paypal and i'm waiting for their decision but i can't help but think something's fishy. like i said, i've never had a problem with a package ever until now and i'm getting pissed off just thinking about it. guys, any advice?

check the tracking number, and if it sayes delivered call the shipping company.
If it hasn't been try contacting the seller, if that don't work, report a dispute through Ebay.
You should know this.

Ya... if is a legit tracking number... it will tell you the status. If it says delivered... it is the shipping company's responsibility to resolve... not the seller.
If it says it was recieved by the shipper and not delivered, it is still the shipper's responsibility... not the seller.
If it says it was NOT received, it is the sellers responsibility and you should resolve this via eBay, Paypal and if need be.. http://www.cybercrime.gov/

Notify ebay of the problem also. Try everything.

Perhaps shipping insurance may have helped with the matter, albeit late. If my memory serves me correct with insurance, you could have filed a claim with USPS.
Even USPS could have made a delivery to the wrong address, ever had a month where you didn't get a credit card bill? Someone else may be playing with your RM now.
If the tracking number is legit and you have not obtained shipping insurance. Sorry, but I don't think you're likely to get back a refund either through eBay or Paypal.
I had a case filed once with PayPal, where I paid months ago, but never got the item and no tracking number. I initially got a partial refund from the seller. I won my case, but with email trail documenting the communication, the seller provided a full refund and the seller is no longer with eBay.
Good luck with your case.

If the seller can provide delivery confirmation, you will lose your claim.
If the seller cannot provide delivery confirmation you will win your claim.
It is almost as simple as that.
I may have read through the posts here too fast, but I did not see you mention there was a delivery confirmation on your package.

Just playing devil's advocate here, but put yourself in the place of the seller. If I read your post correctly USPS provided confirmation that the package was delivered. As far as the seller is concerned he did everything right, and has confirmation that the item he sent you was delivered. The seller could just as easily make a case that you are trying to scam him. I'm sure that is not the case, but it sounds to me like any blame is on USPS.

packages sometimes get lost. if the package was dropped off at your home, it might have been picked up by someone passing by. This has happened. Our post office drops off a little pick up package card if we aren't home. HOWEVER the one time I was home, I went down to pick it up and the posty had left it un attended by the elevator. ANYONE could have taken it.
