such violations include, but are not limited to:
being under 18 and using google
lying about your age/sex on myspace
using a dating site while not single
lying about your weight on a dating site
now the government has stated they don't really have the time or resources to search for this kind of thing, so its basically a dont get reported

This is all well and good, but it doesn't cover using google while under 18, and it also doesn't cover falsifying information after agreeing to terms of service unless you then use it maliciously.

Perhaps I'm reading this wrong, but this looks rather like it pertains more to the hacking of computers than to anything resembling legislation concerning Terms of Use. It's also quite old.

We had a thread about this incident a while back. A woman created an account on MySpace, pretending to be a young boy. She used the account to get close to a young girl then after developing a relationship used it to harass her as the boy she supposedly fell in love with. It was all rather cruel, hence the malicious intent. The girl ended up committing suicide.
The section of the legislation is I believe what was used to prosecute her, so the age of it doesn't really matter.
If I'm honest, if you're going to do what this woman did, and create an account with sole purpose of attacking someone and causing them mental strain to the point of suicide then you deserve to be punished. I'd be perfectly happy to let anyone else doing this go the same way.
