We have recently heard about the possiblity of a Black Zarak Energon Scorponok repaint. Prototypes have been floating about on Ebay.
However, we have just seen this image which shows him in the official convention comic.
While this is not proof by any stretch of the imagination it does lend credit to the posability of getting this repaint. After all, as far as I am aware, the comic has only really used characters who are available.
As ever, time will tell.
