While the copyright element obviously determined the decision to use Hot Shot instead of Hot Rod, the fact that the Classics Universe line included both a Rodimus and a Hot Shot, each in its own mold, strongly suggests that they are in fact two distinct characters who merely shape a personality type.
Also, the TF Energon cartoon and toyline both featured Rodimus and Hot Shot as completely separate individuals.

In all fairness, "Hot Shot" is Hot Rod/Rodimus. He was renamed for the sake of copyright.
