Well folks their side requested an adjournment based on costing more to get a new barrister and guess what???

The court basically said "up yours!" so we're game on for Tuesday....134 hours.

They now need to find a barrister at extreme short notice to read all the case and get an argument prepared...good luck with that I say, probably set them back another £5000 to get someone good at short notice, as well as making it very difficult to defend if you've only got 3 days to prepare.

Not counting all my chickens before they've hatched but I'm certainly feeling more confident about this now.

Updates next week folk once this first stage is over with....

I think your former employers strategy is to delay this case until someone dies of old age. I'm glad to see that this case is finally getting underway.

Good news bad news folks

Bad news:

They have got the original Barrister back as his other case he was tied up with settled so he is now free....strengthens their argument a tad.

Good news:

They have FINALLY conceeded that I did work for them and altered loads of evidence to that effect. The advantage here is that the judge will be p****d that they lied for so long as wasted everyones time on something they knew to be correct from the start. Also gives me the opportunity to ask for costs back (which would enable me to pay the Barristers and have some free money for me)

The other advantage to this is that its a much shorter hearing with less points to considers thus less stress, its listed for 2 days but we will probably get this heard inside a day.

Updates likely Weds eve....

Crappy on the Barrister front, but it looks like they are caving under the pressure. Keep pounding them on facts and the ball should stay in your possession.

So folks the day has been and gone....for amusement purposes I'm going to talk you through the day before going to the outcome...those who wish to know 1st please skip to the end of this post.

To set the scene this is a small court (informal so no wigs and jury etc) with a single judge, a panel of my solicitor and barrister and their solicitor and barrister. We then have rows of chairs at the back where witness's sit. As there is only me and some useless H.R. bint you'd imagine the seats to be empty. Hell no, the bunch of bankers have bought an entourage of Mariah Carey Diva like proportions with them.

8 people occupying the seats including their witness with notepads and pens at the ready, part of me thought this is likely an intimidation tactic as any other person would be like..."OMG I feel so overwhelmed"

Me I'm like....."Awesome an audience, and more salaries of staff getting wasted sitting down doing nothing thanks to me" so failure on point one

Well I'm up for questioning first by the worlds largest law firm and their barrister. To cut a long story short, I did excellent (of course I will say that, but as did my barrister) not one iota of my evidence was disproven by questioning, despite their best efforts as I'm fully able to hold my own.

As we leave the court for lunch their solicitors turns to their barrister and says in a very accusing tone "well that didnt go well...DID IT??!!" not realising that I was there...I take this as a good sign.

So we then break back from lunch and its this H.R. bints turn. Now consider they initially said they never employed me and it was a different company, this limited them to a massive extend on their evidence they submitted months ago. This woman's evidence was she had no involvement with me after I flew to Singapore.

In brief my barrister ripped her to shreds on the witness stand as she admitted her had no factual basis for anything in her statement and they went through and crossed out paragraph by paragraph everything she couldnt back up, when she tried to defend it my brief just kept up with the same line of "so what are you basing that on????"

End result was this woman retracting everything on her statement bar her name (and giving lots of evidence that supported me through doing this as) and as she was the only witness and couldnt argue ANY of my evidence, and as their barrister couldnt pull it apart..ALL my evidence was accepted as fact as it wasnt challenged.

We then moved onto the closing submissions which referenced in all the law...this took us to just over 5pm and a very tired judge. He has retired to consider the verdict and will notify us of judgement via the post. This could take weeks as it isnt just a "yay" or "nay" he has to write a "judgement" of why he is reaching that conclusions, and if posted this will need to be typed which could drag on for a while.

So in conclusions, all the facts have been heard, and we now have to wait for an answer to this stage, but all in all it went as well as it could have done for me, so I know that even if I lose, it will be on a point of law and not due to being bullied or railroaded by the other side which has made me feel quite good as it does give me some closure....

In other news I imagine this HR woman to be facing a grilling for the shambolic performance she gave with her evidence, she might potentially have been a scapegoat for this as the bank will **** on people from a great height if required....can't say I'll lose that much sleep over this to be honest....

As per usual...I'll update you folks when I get the verdict...could be hours...could be weeks

Well, her failure was more the fault of the legal minds that came up with earlier strategy of "He didn't work for us". I'm sure the HR person really didn't appreciate being set up like that.

Very true, I can't help be feel she was made a scapegoat as she is generally crap at her job. Whatever the case though, I have no sympathy for her whatsoever, she made her bed by giving evidence against me (no company can force their employee's to give evidence, she must have been complicit to some degree) so she can lie in it.

I was tempted to send her a thank you card with some chocolates and a note saying "your cut will be in the bank this Friday" to her at work....might generate a few rumours about why she performed so bad :twisted:

chased up the court...still with the judge awaiting his verdict...I am working on the logic that the longer it takes him to decide then the more thought he is giving it

I just found this thread and read the entire thing. It is absolutely horrible what they have done to you. I hope you win the court battle as well as a pile of money to aid in your "recovery"! Haha! :grin:

Now that I have said that, please give us an update!

hi guys, update thus far.

The file went from the original judge back to a panel of 3 more judges, who after much deliberation reached a verdict on 4th November, the file was then dictated and sent to the tpying pool, the typist then sent it back to the judge to review who made some amendments and then sent it back to the typist who typed another draft copy, and it is now back with the judge to be reviewed before being posted.

So as you can see a verdict has been reached and just needs to be posted to me, I imagine you are as eager as I to hear the verdict....oh no you need to wait until it signed and posted, they cannot tell me over the phone.

Rung up yesterday chasing it, but it is still on the judges desk which is really bizarre to feel there is nothing i can do to influences this as the verdict is reached, but I'm now waiting for it to be posted to me.

This is the true meaning of total frustration I think.....

At 4pm today the verdict was emailed to me by my solicitor.

All 4 claims submitted have gone in my favour, nothing has gone in the bunch of bankers favour.

We are now poised to go to a full hearing to discuss the dismissal and fraud etc, however the other side can appeal this if they wish and drag it right back to court to be re-heard, should they do that however we have already hinted we would submit a claim for costs regarding their lies of not employing me, so an appeal will costs them in the region of a further £20,000, and they still might lose that.

Currently bouncing off the walls with glee folks :grin:

Right folks, I have not posted a reply so as not to tempt fate....didn't work though.

The judgement was reached on 7th December with a 42 day window for them to appeal, meaning it has to be in by 18th January at the latest...

2pm today (1day before the deadline) the total &*$@"'s put in an appeal, much of it was to get to the stage where I think I've won and irritate me that little bit more....

The grounds are dire to say the least so there is a chance this might get rejected on the basis of no reasonable grounds of appeal, but if not it means back to the appeal court to re-hear this whole territorial jurisdiction issue. Annoyed as this drags it out further, however all verdicts are published in the Times Law reports each Sunday so they know they are running the risk of exposure by pushing this up and I suspect they are waiting to see what I am doing...

Those of you that have been reading and following this case since the start can probably guess exactly what I shall do....
