Also, I don't believe that he's actually the original creator of that image, the whole thing sounds like that case with the Korean company that "invented! the practice of linking with images and sued everyone that used "their" technology.

That's not strictly true, Fair Use and Copyright Laws are a lot trickier than you'd think. Being posted on the internet doesn't immediately rob you of copyright. Reaching meme status doesn't mean it's public domain, it just means finding a suitable defendant is going to be a pain in the ass, if not downright impossible.
