(R) is a Registered Trademark.
The difference between a Registered Trademark and a Trademark? In theory, nothing. In reality, it's much harder to win a trademark infringement case if it's not registered.

With a ®, they own the use of the trademark. But the trademark itself is owned by the goverment. They could still sue you, but have to do so with the goverment's permission.
The display of tm and ® (and ©) is you that in terms of legal incidents, you know to whom you must appeal.
