Many of the criminals he fights have families of their own, loved ones as well.

Not that it matters much in the eyes of the law.

The idea is that showing respect for human life, no matter what the life in question has done, is what separates him from his enemies. He's already decided he's not the one who gets to choose who lives and who dies. What you're suggesting, declaring yourself judge, jury, and executioner actually makes you worse than, let's say, Two Face, during his faux-vigilante days. The problem, though, is particularly with the Joker. It's been proven what Batman does not work on the Joker.

The real reason: He's got immunity.
