That's not strictly true, Fair Use and Copyright Laws are a lot trickier than you'd think. Being posted on the internet doesn't immediately rob you of copyright. Reaching meme status doesn't mean it's public domain, it just means finding a suitable defendant is going to be a pain in the ass, if not downright impossible.
