Probably won't come out right, here, basically, I bought the re-issue Diaclone Colored Ultra Magnus. You can clearly see in the title of his auction that he says it is MISB-- which means "MINT IN SEALED BOX". I sent an e-mail inquiring about why it was not stated as opened and displayed in the auction, as it had dust on it, and the pieces were obviously not MISP nor was the tape on the box sealed it was obviously sliced, and not even retaped.

He replied that he never stated it was Mint in sealed box, but Mint in box, hmmm...from my experience that acronym is MIB, or MIB complete. He also stated I needed to ask all questions before bidding. Ugghhh...I've never left negative feedback, but he may get it to be the first. Of course, then he will nail me with it, when all I did was pay the same minute I bought it, and accepted his word as stated...

So I was upset for paying MISB price, for a MIB toy. And apparently, I have no right to be.

Contact eBay. I'm not sure if MISB is an official term or has any weight so you might not have any joy but it's worth a try.

That is really poopy.

You should hit him with the worst feedback you can muster. If he responds in kind, mention that "InSide" remark in the feedback follow up.

I absolutely HATE being misled on ebay. You should hit that sale up from all angles, Ebay moderators, Paypal admin etc etc. He clearly misrepresented the item.

Don't get me wrong, I love the item, but it was obviously used, and not stated anywhere that it was.

MISB is a collector term that is taken as meaning MINT IN SEALED BOX.

He obviously knows the difference because in his Star Convoy auction he lists it as MIB

I'm new to ebay. What negative type of feedback could he leave a buyer if the buyer paid immediately? Besides paying speed, what else is there for a seller to criticise a buyer about?

That is the LAMEST excuse I have ever heard. You're right about him damn well knowing the difference between the 2 terms. I would report him since the listing is in fact mis-leading.

Another alternative is to keep it (if you're happy with the item that is) and then leave NEUTRAL feedback for him stating the poor/inaccurate description...but then you leave yourself open to negative retaliation feedback.

If it were me, and I was happy with the item as is (which I wouldn't be), I would just keep it and not leave any feedback (unless he does FIRST).

Sucks man, hope things turn out for you!

That's why I hate the feedback system. Sellers should have to leave feedback before they can receive it. If I pay immediately and receive horrible service and a crappy product, why do I then have to risk the negative just to warn other people?

EXACTLY! That's one thing that has always puzzled me about it. The first order I made and paid immediately, I asked the seller for feedback on my side of the transaction, and she told me that sellers don't do that so they can use it as retaliation against bad feedback... I mean WTF!

As far as buyers' side stands, our responsibility is to bid, and then pay for what we bid for, including the bullshit S&H we have to pay (this son of a b!7c4 from Hong Kong told me he shipped Masterpiece OP internationally for USD$61; and it was the same even if he was selling to Hong Kong!)

We then have to trust the item is sent out, that it will arrive, that it will arrive in good condition, that the items is what is advertised... Who's always on the losing end? Something should be done about the way the feedback system works.

Just to play devil's advocate for a mo, on the feedback issue, I can also understand why sellers might hold off on giving feedback. Buyers can be arses too.

On one particular occasion someone bought a lunchbox from my girlfriend (for about £4, as I recall). Payment was okay, and the missus left positive feedback. A couple of weeks later, she got negative feedback in return saying the item never arrived and that my g/f had ruined her daughter's birthday. The item had been sent out the same day.

Aside from wondering what kind of parent hinges their daughter's entire birthday on a four quid lunchbox and doesn't even request tracked delivery anyway, the buyer never once messaged to check if it had been sent.

And it's that kind of thing that makes sellers want to hold off on their feedback... just in case.

You CAN complain about this.

Fill out a report to paypal that the item was significantly not as described. MIB and MISB are accepted and widely used descriptions for collectors items, such as music collectors use a recognised grading system for quality.

I have been refunded money before for buying an item that was not as described, and I told the seller if he paid the P&P he could get his item back again. He never bothered getting back to me.

I'd say you have grounds to dispute. The guy mislead you, whether it was intentional or not. Sellers should know what they're posting, and misleading listings are against policy. At the very least you should get a discount, and not have to deal with his retaliatory feedback... perhaps an agreement to mutually withdraw?

Usually a buyer gets a negative feedback even the item is paid immediately is a retaliation of the seller because the buyer gave the seller a negative one.

About 99% of eBay transaction go well. In 1,000 transactions I have only had one negative experience. Still, this situation was a clearly misrepresented item. eBay discourages the use of acronyms due to the potentioal for communication misunderstandings.

The seller was wrong, but as a buyer you should always ask, especially if something like it truly being MISB is important to you. Otherwise buying an unseen or photographed product is always a gamble.

I remember back when the PS2 was released, eBay scammers were listing an item phrased "you are bidding on the PS2 picture below." Bidders wopuld bid up the price of a real PS2 and only get a picture of the PS2 in the mail. eBay squashed that misrepresentation real quick, but not before dozens lost money.

For one thing please realize, the item is great I want to keep it so I don't care for money back in full.

And yes, I know buyer beware, but I do not expect to have to question a person on whether they know what MISB or MIS is. MOSC, MISP, MISB all mean the same, and when you include that acromnym you are saying something about your item that is understood in the collector's community.

I should eat a negative feedback just to warn others of this guys ineptitude, and that he is looking to deceive to earn a quick buck.

Obviously, a MISB version would be worth the price I paid. A MIB complete that I received, probably half.

He's not responding anymore, so I have to decide whether I want to take this further or not.

Thanks for the feedback. I have had 2 bad transactions on Ebay and over 200 good ones, so yes it is a small percentage, and I was due.

I was simply posting to share the funny new acronym and see what people thought. Thanks! :D It could have been much worse.
