I always put a note inside of the packaging that explains the problem with the toy, then I reseal it with packaging tape. If they put it back out on the shelves and take the note out of the packaging, then it's not on me. I'm assuming the toy is returned to Hasbro somehow for credit as damaged goods or whatever. At least that's what I'm hoping happens to figures that have flaws.

That's how it should work. When I worked for Best Buy, any time a customer returned an item as defective (especially a small item, such as a cable or spindle of blank CDs etc.), we just taped it up with our 'Best Buy' packaging tape, put a special tag on it that basically meant 'don't put this on the shelf for sale', tossed it in a large box with other such returned items and eventually shipped the box out to be returned for credit (though some items were destroyed as they were un-returnable I guess).
With larger items, such as TVs and PCs, the tech guys (GeekSquad) would test them, and if they found them not to be defective or if they were able to repair them, we'd put them out on the sales floor as open-box items with a marked down price.
