I doubt there's a class action anything here. Toys break.
But yes, I foresee plenty of unhappy children crying their eyes out over these. However, most of the people I knew growing up, when I was a kid...they didn't care if their's broke. They just used the pieces for something else, like an add-on to their G.I. Instructions won't save you. He's absolutely infuriating. It's not a matter of mistranformation, it's a matter of those damned tabs get in the way, and they really shouldn't be there. There's still enough of a clip on there to hold the shoulders in place, I'm considering cutting the tabs on mine, because you have to stress the arms a bit to get them to swing around for clearance. (BAD design. I mean BAD.)
