the seller is asking for $38 for postage, the items only cost 3cent!

Link to the auction, if he stated before the auction that postage was that price you have to pay it no matter how unfair it is, it's one way sellers avoid paying eBay's commission. If he didn't state a price for postage before you won the auction that's another story.

No, they can not.
And if you got them for $0.03 with $38 shipping, that's kind of your fault. The seller is obviously trying to get around paying Ebay fees with that pricing set up.
(Actually, $38 is about what they should cost at retail + shipping, $15 for Skybite (not including mark-up as the figure is several years old), $10 for Strika + tax and shipping)

Check 'my ebay' for any sign of it being listed as 'hand delivered by a gold plated tooth fairy' on the original page. If there is nothing mentioning the delivery cost, email his ass and flame the sucker, then contact eBay.
If the postage was listed on the original sale and was there from the start, suck it up and read the auction better next time...

If you didn't send him a message asking him about the postage before the end of the auction you might have a problem. He could just use the argument that you didn't bother asking him beforehand and it ain't his fault if you think it's too much. It's no excuse for him bumping up the price though

Anytime I see someone doing that, I always report them to ebay. They are just trying to get around paying ebay and at the same time are over charging you for something. The only time I might not complain is if you got a ridiculous deal that would be far cheaper than if you bought it at a store or from another seller. Ebay has been cracking down on people trying to cheat the system and I noticed that they are starting to crack down on knock offs as well. I've seen a bunch of knock off Transformers auctions get shut down early.
