You have to keep in what function Vector Sigma serves.It "PROGRAMS" a TF with life.
Which would mean that its possible for others to duplicate that programing if they are smart enough.
Wheeljack and Ratchet obviously can program life....even if that life has limited intelligence.
When Grimlock was given super intelligence he created the Technobots.
"Sparks" didnt really come around till Beast wars and truth be told its a hard fit into the G1 world.
But I do have some ideas.
If Megatron, as he boasted so in the 'toon, actually did create the Constructicons, how do we assume exactly? Was it the work of Vector Sigma, or did Megs build them from scratch?

never said he "CREATED" the Constructcons.
Thats a misconception most fans have due to 2 reasons.
1]Megatron used a word that is
"SOMETIMES" synonymous with create.
@] they were new characters from the fans point of view so we believed he ment create.
Megatron said he "BUILT" the Constructicons, but "to build" does not always mean "to create".
The shows pre-production bible states that the Constructicons were to be given no origin story when introduced so that they could add to it later.
which they did by showing the Constructicons on Cybertron over 4 million years in the past.
This, combined with the fact that none of the Aurtobots seemed surprised by the appearance of the Constructicons or their combined form of Devestator in their first cartoon appearance suggest that, while they were new characters to us watching the episode, they werent new characters to each other.
Which would mean Megatron ment he "built" them new earth forms.
