I'm pretty sure you would have zero grounds for a lawsuit. First, Target's decision to make it a RedCard excluding has nothing to do with Hasbro so why would you sue them? I'm just as annoyed by this, and hoping that they won't go out of stock before my card arrives, and will be cancelling my card as soon as I pay off RedWing if I'm lucky enough that he is still available whenever my card gets here.

I don't have to be in anyone's legal department to have a pretty good idea that suing Company A for a decision Company B made on how to sell Company A's product has very little chance of working.
As for the second item, would you have called their checkout process gay? I'm guessing not. Why would a disability be any different than race or sexual orientation? Taking something that is a definitive quality about a portion of the population and using it as a negative insult to something that it doesn't apply to just isn't cool nowadays. I say this as someone who used gay and retarded as insults myself when I was younger, but I eventually grew the hell up and realized it just isn't cool. Many more people than you may realize care about people who may be retarded, or gay, or whatever.
