Well, if you're just talking about the name... It's a fairly obvious use of latin, especially after the movie Gladiator. Of all the permutations I've seen of the name Optimus Prime, it is actually probably one of the most obvious. I imagine a lot of TF fans have used the name, before and after 2001.
If however the character depicted in MP's bio is a copy of the character in your fanfic, and you have evidence of the fanfic's publication date, than I'd say you deserve a writing credit.
So, what is it you're talking about, the name "Maximus Prime" or the character from your fanfic?

In my own little storyline (which I'm thinking about writing down, I haven't decided yet), I have a character named Overdrive, who is operations officer on the Ark, transforms into an F-150, and whose personality is based off my own, in that even though he isn't the biggest, he has one of the biggest "hearts" and will do what is required of him. Well, during the final battle between Optimus' Autobots and Megatron's Decepticons, Megs unleashes a deadly weapon that wipes out most of his own force as well as nearly every Autobot. Only Overdrive survives by hiding under the fallen body of Devastator. When the surviving Decepticons leave, Overdrive goes in search of Optimus Prime. He finds him and realizes that he is going to die. So Optimus tells him of a ship that apparently was sent out to find the Ark but crashlanded on Earth. Then Optimus gives Overdrive the Matrix and (like Hot Rod to Rodimus Prime), Overdrive is transformed into the new Prime and changes from an F-150 to a F-450. Now, when I was coming up with the name of the new Prime, I wanted something unique, simple, and meaningful. And then I had an idea as I was either watching or thinking about the movie Gladiator and the central character, Maximus, who falls from glory to slavery and leads the gladiators in a revolt against the Emperor. And I thought to myself, "That's what my guy's doing! He is having to rise up from defeat, rally a group of somewhat rag-tag warriors, and challenge the power that rules over Earth." (BTW, after the Autobots are defeated, Megatron builds a new army from reprogrammed Autobots in orbit around Earth when the Ark fell under attack by the Nemesis-- kinda like the Axalon. After he builds his army, he enslaves the human race and hoards every energy source on the planet and prepares the Nemesis for their return to Cybertron.) So that's how I arrived with my character, Maximus Prime.

Well, regardless of whatever arguments you may make, when people refer to Maximus Prime, they will be referring to the former moderator, an actual person in this case not a character, 99% of the time. Even Hasbro couldn't change that if they wanted to - when we talk about Glyph it is understood that we're talking about the former programmer, not the minibot cryptologist.
